The $5 million Michael Jackson syringe

Would you want to own the syringe which allegedly administered a deadly dose of drugs to Michael Jackson?

This story receives our bizarre dirt bag award. Should this type of sale even be allowed?

“The man who has received the needle (by secret means) has been in meetings with his legal team, to make certain it is genuine as well as his to sell. His plan is to whip it for up to $5million in a large Vegas casino auction, though he’s been told he might have to sell it somewhere which doesn’t have ‘reciprocal authorized agreements with a United States’.

The effect of a sale is to make a difference of interpretation; contingent upon a DA belief a crime has even been committed.

“Rumors have it the Jackson family is outraged of the auction plan, wouldn’t you be?

“They have been mad as well as disheartened that someone is once again seeking to exploit this tragedy and profit from it. It’s an incredibly sad and hard time for them,”

The autopsy suggested Jackson died from “lethal levels” of an absolute anesthetic, propofol. Murray, who had been treating Jackson for his sleeplessness for 6 weeks, is purported to have prompted sleep by administering drug such as valium, lorazepam as well as midazolam – prior to injecting a deadly dose of propofol. Last month Murray denied the charges but if found guilty he could face up to 4 years in prison.

My heart goes out to family for the loss of Michael Jackson and they have every right to be angry and outraged. I believe the syringe should be treated as a bio hazard and dealt with accordingly. This would keep such an auction and exploitation from taking place.

Although Nevada has no regulations on disposal of medical waste, I’m quite sure the Jackson family can find a loop hole to stop this sell from taking place. One might point them to the fact of homicide which could then turn into a federal matter where proper management of bio-hazard material would come into play.

According to Nevada Regulatory Framework

Nevada regulations do not require treatment of medical waste. Disposal in a permitted landfill according to approved practices is acceptable. However, until the waste has been either treated or disposed, it must be stored and collected according to the requirements of Nevada Administrative Code (NAC) 444.662. (Note: the Washoe County District Health Dept. has infectious waste regulations which do require treatment before disposal.)

There is no comprehensive federal regulatory program for the management of medical waste. The US Occupational Safety and Health Administration (OSHA) have adopted regulations to limit workers’ occupational exposure to blood and other body fluids which may pose a risk of infection by bloodborne pathogens (2)

If the case were to become a federal matter then I would think the needle could be seized and perhaps destroyed under federal guidelines or if nothing else, locked away as evidence for eternity.

Homicide cleanup and crime scene cleanup involves the removal and cleaning or disposal of items that have been contaminated with body fluids / blood, or tissue matter, but does not stop there.”

Federal Regulation 29CFR1910.1030

Bio hazard cleanup laws are imposed by multiple agencies in order to protect the public’s health and safety. There are Federal and State Laws and Regulations regarding transportation of some biohazards. The provider must have hazmat certification in order to handle such materials that may be incinerated and transported. (How this item could even be transported across state lines or over seas is a mystery to me.)

As of 2004, injection drug use accounted for about one-fifth of all HIV infections and most hepatitis C infections in the United States

Syringe prescription laws. These laws prohibit dispensing or possessing syringes without a valid medical prescription. In 2002, eight states and one territory had syringe prescription laws. In 2000, an analysis of state laws

Public Act and Rules Governing Disposal of Medical Waste

(E) “Syringes,” as included in the definition of “sharps” under §13807(7) of the act, includes all syringes with an attached needle and those parts of a syringe, with or without an attached needle, that are contaminated with a potentially infectious agent.

Needles shall only be removed from a syringe in accordance with the procedures established by R 325.70007(2)(e) adopted under section 24 of Act No. 154 of the Public

Acts of 1974, as amended.

History: 2000 MR 19, Eff. Nov. 30, 2000.

R 325.1543 Treatment of medical waste.

Rule 3. (1) Blood and blood products and body fluids that are solidified, but not decontaminated during the solidification process, shall be packaged and disposed of as medical waste as specified in §§13809, 13811(b), and 13821(b) of the act.

History: 2000 MR 19, Eff. Nov. 30, 2000.

No matter which way you look at this, morally or legally, it is wrong and should not be allowed. Some agency needs to take action now and retrieve this instrument and make it clear to all that this type of exploitation will not be tolerated. What is next? In 2029 will see the bullet fragments from the Kennedy assassination going on the auction block to the highest bidder? What are your views?
